OFFICIAL RULES – NATIONAL AVIATION HISTORY MONTH
SOCIAL MEDIA CONTEST
The San Diego County Regional Airport Authority (“Authority” or “Sponsor”) is sponsoring a 2015 National Aviation History Month Social Media Contest (“Contest”) where individuals enter the Contest through Twitter, Instagram, or Facebook (referred to herein as “Social Media Platforms”).
NO PURCHASE OR CONTRIBUTION IS NECESSARY TO ENTER OR WIN THIS CONTEST.
Void where prohibited. Individuals will have three (3) opportunities to win prizes. A total of one (1) Entry may be submitted per week per Entrant, for a possible total of three (3) Entries over the three (3) weeks of the Entry Periods. Individuals who participate in the Contest or submit an entry are referred to herein as “Entrant.” A(n) official entry(ies) submitted in accordance with these Contest Rules is(are) referred to herein as “Entry(ies).” By submitting an Entry, you agree to be bound by the following Official Rules:
Making a purchase or contribution is not a requirement to enter the Contest nor will it necessarily improve an Entrant’s chance of winning.
A new photo will be posted on the Authority’s Social Media Platforms weekly at 9 a.m. PST on Nov. 9, 2015; Nov. 16, 2015; and Nov. 23, 2015. The Entry Period begins at 9 a.m. PST once the photo is posted, and ends at 5 p.m. PST the following day. Any entry received before or after each Entry Period (i.e. before 9 a.m. or after 5 p.m. PST the following day) will not be eligible to win a prize that week. Contest Sponsor’s computer is the official time-keeping device for the Contest.
To be eligible for entry in the Contest, Entrants must:
1. Be legal residents of the United States;
2. Be eighteen (18) years of age or older at the time of entry;
3. Be following, at the time of submitting an Entry, the San Diego International Airport on the Social Media Platform in which the Entrant submits his/her Entry on:
a. @SanDiegoAirport on Twitter
b. San Diego International Airport’s Instagram page
c. San Diego International Airport’s Facebook page
4. The following individuals are NOT eligible to participate in or receive prizes from the Contest: employees, officers, directors, immediate family members (spouse, significant other, parent, child, sibling or their respective spouses, regardless of where they reside, or member of the same household, whether or not related) of the Authority or any airport tenant, contractor, service provider or other entity contracting with the Authority.
How to Enter:
1. Each Monday morning during the Entry Period, the Authority will post a new photo on its Social Media Platforms.
2. Entrant’s submission must consist of a made-up caption that applies to that photo.
3. Facebook Entries: If you have not already done so, “Like” the Airport Authority’s Facebook page at http://www.facebook.com/sandiegoairport;
• Find the weekly contest photo. Enter your caption in the comment section of the post.
• Include #SDAvHistory hashtag with your answer.
4. Twitter Entries: If you have not already done so, “follow” @sandiegoairport on Twitter;
• Find the weekly contest photo by searching #SDAvHistory; and
• Tweet your answer. Answer must include the hashtag #SDAvHistory.
5. Instagram Entries: If you have not already done so, “follow” @sandiegoairport on Instagram;
• Find the weekly contest photo by searching #SDAvHistory; and
• Enter your caption in the comment section of the post.

The Contest Sponsor is not responsible for entries that are not received for any reason, or for entries that are received, but are not decipherable for any reason. The Contest Sponsor will automatically disqualify: (1) any entry submission from a non-eligible individual; (2) an incomplete or illegible or non-responsive entry; and (3) any entries received in excess of the entry limit described herein.
There will be three (3) Contest winners (“Winner(s)”).
One (1) Winner will be selected on each of the following days: Nov. 11, 2015, Nov. 18, 2015 and Nov. 25, 2015, based on the creativity of the Entry. Winner Prizes are the same for each entry period: A four-pack of tickets to the USS Midway Museum in San Diego valued at $80 total. All prizes referred to herein as “Prize(s).”
Any valuation of the Prizes stated above is based on available information provided to the Contest Sponsor, and the value of any Prize awarded to a Winner may be reported for tax purposes as required by law. Each individual Winner is fully responsible for any and all applicable federal, state and local taxes and fees/charges (including income and withholding taxes) for his/her respective Prize. Each individual Winner must provide to the Contest Sponsor a valid government identification. All costs and expenses associated with Prize acceptance and use not specified herein as being provided are the sole responsibility of each individual Winner.
Unless otherwise noted, the Prize is subject to the terms, conditions and restrictions of the Prize Sponsor, i.e., the Authority. Released Parties (defined below) will not be responsible for acts of third parties, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of awarding the Prize. The Prize is non-transferable, non-assignable, and cannot be redeemed for cash or substituted, expect by Sponsor (in its sole discretion), which reserves the right to substitute any portion of the Prize with a prize of equal or greater value for any reason, including, without limitation, Prize unavailability.
Odds of winning depend upon the number of eligible Entries received during the Entry Period.
One (1) Winner will be selected based on a subjective review of each entry by a panel of judges, which will determine the most creative response each week between Nov. 9, 2015 and Nov. 24, 2015. There will be a total of three (3) Contest Winners.
The decision of the Sponsor’s President/CEO or her designee is final and binding on all matters relating to the Contest. Each individual Winner shall be required to sign the Authority’s Affidavit of Eligibility and its Liability/Publicity Release form within ten (10) days of prize Notification, described elsewhere herein. Should an individual Winner not complete the required forms within ten (10) days of prize Notification, said Winner shall be disqualified and the panel of judges may then select an alternative Winner from the eligible Entries.
On or about 5:30 p.m. PST on Nov. 11, 2015, Nov. 18, 2015 and Nov. 25, 2015, the Contest Sponsor will contact (“Notification”) the Winner on the Social Media Platform in which the Winner submitted his/her winning Entry. Each Winner shall, within ten (10) full calendar days of issuance of the Notification, provide the Contest Sponsor with the following information: (1) eligibility information, i.e. proof of age and U.S. residency; (2) name; and (3) winner’s preferred email, mailing addresses and telephone number. In the event the Notification is returned as undeliverable, or the Contest Sponsor is unable to reach an individual Winner at the e-mail address and phone number provided by the Winner for any reason, the Contest Sponsor may select an alternative winner who will be notified in the same manner described above and said alternative winner must provide the Contest Sponsor with the information specified above. In the event any alternate winner fails to respond to any such Notification within ten (10) calendar days of the date of issuance, the alternate will be disqualified, and the Prize will be forfeited, at the Contest Sponsor’s sole discretion. Failure to timely submit required documentation as described herein will result in disqualification and forfeiture of the Winner’s respective Prize.
Waiver of Liability/Publicity Release:
Participation in the Contest constitutes the Entrant’s full and unconditional agreement to and acceptance of these Official Rules. By participating in the Contest, the Entrant represents and warrants that he/she has read and fully understands, and agrees to be bound by these Official Rules. By participating in the Contest, Entrants waive any and all claims against the Authority and each of its representative and any and all other firms associated with the Contest, and all of their respective officers, directors, employees, agents and representatives (collectively, “Released Parties”) for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from participation in the Contest or from the receipt or use of the Prize or activity related to the receipt or use of the Prize. By participating in this Contest, each Entrant gives his/her express permission to be contacted by the Contest Sponsor and/or its respective designees by telephone, email, social media, and/or postal mail for Contest purposes only. Each individual Winner, by acceptance of his/her respective Prize, grants to the Contest Sponsor and each of its respective designees the right to publicize such Winner’s name, city and state of residence, photographs, voice, statements and/or other likeness and Prize description in any media now known or hereafter devised, throughout the world, in perpetuity, without limitation and without additional compensation or consideration, notification or permission, unless prohibited by law.
By entering this Contest, the Entrant agrees to the following Statement:
I expressly understand that Section 1542 of the Civil Code of California provides substantially as follows: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER, MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH DEBTOR.” The provisions of this Section 1542 of the Civil Code of California and any similar law of any state, territory, or other jurisdiction are hereby expressly waived.
This Agreement will be governed by the laws of the State of California. Any court of competent jurisdiction sitting within San Diego, California will be the exclusive jurisdiction and venue for any dispute arising out of or relating to this Contest or these Official Rules. Entrants hereby waive any argument that any such court does not have jurisdiction or improper venue regarding any and all disputes arising out of the Contest, including the award of the Prize. The Contest Sponsor shall be entitle to recover its court costs and reasonable attorneys’ fees and expenses incurred in successfully proving any breach of any term of the Contest or these Official Rules.
The Contest Sponsor reserves the right, in its sole discretion, to amend, modify, extend, cancel or suspend the Contest (or any portion thereof) should virus, bugs, unauthorized human intervention, or other causes corrupt administration, security, fairness, integrity or proper operation of the Contest (or any portion thereof). Sponsor also reserves the right to make changes or additions to these Official Rules for any reason at any time. In the event of cancellation, the Contest Sponsor may elect to identify winners and award the Prizes, by the criteria listed above, from among all non-suspect, eligible Entries received up to the time of such cancellation. Entries generated by a script, macro or other mechanical or automated means will be disqualified
